ICC CODE HEARING UPDATES 

Updates from the ICC Final Action Hearings – Part Two
October 2010
Charlotte, N.C.

  • ICC members disapproved a bylaw change to require a post-hearing ratification vote for code change proposals 
  • Chair-Elect Boyd Zoccola traveled to Charlotte to represent BOMA in meetings with the ICC leadership and addressed the ICC Board of Directors, citing the importance of a strong BOMA/ICC relationship. He thanked ICC for achieving an agreement with ASHRAE on green codes. Zoccola also expressed BOMA's concern with the possible adoption of the draft IGCC by state and local governments
  • ICC CEO Rick Weiland cited BOMA's influence as a primary factor in securing the agreement with ASHRAE to reference Standard 189.1 in the IGCC
  • The so-called "30% solution" proposals for residential energy efficiency from DOE and supporters were all approved
  • Residential efficiency levels mandated in the 2012 IECC will now be about 30% more stringent
  • DOE's "30% Solution" residential changes were approved without serious consideration of compliance costs
  • Credits for the use of more efficient equipment in residential buildings in the IECC PERFOMANCE PATH were disallowed
  • In the 2012 IECC, no credits will be allowed for installing more efficient equipment in either the prescriptive or the performance path
  • An action eliminating efficient equipment credits ensured home builder opposition to the adoption of 2012 IECC
  • First commercial building energy code change debated - EC147 - modified the entire commercial section to achieve 26% efficiency gains
  • EC147 was proposed by DOE, AIA and New Buildings Institute and supported by the "30% Solution" coalition
  • BOMA secured modifications to EC147 to eliminate our major concerns and we supported these modifications at the hearing.  EC147 was approved with these modifications – a significant success for BOMA.
  • BOMA secured modifications to AIA/NBI proposal EC165 to establish more stringent glazing requirements.  EC165 was modified to maintain a 40% window to wall ratio currently in code that benefits large number of commercial buildings.
  • BOMA persuaded DOE to withdraw a proposal mandating renewable energy systems on all commercial buildings
  • BOMA helped defeat a proposal to require permits for replacement of more than 10% of the lighting fixtures in existing buildings

May 2010
Dallas, Texas

  • ICC voting members agreed with BOMA's opposition to proposals for "potty parity" for smaller retailers and restaurants and the change was disapproved
  • Significant additional toilet fixtures ("potty parity") for small assembly occupancies was also disapproved by ICC voting members
  • BOMA successfully opposed proposal for all existing high rises to retrofit sprinkler systems, saving BOMA members billions
  • Ray Mackey addressed the ICC Board of Directors and congratulated them on crafting agreement with ASHRAE on green building codes
